Terms and conditions
These terms apply when you use the Gift Diary website and join our waitlist. Please read them. By using the site, you agree to them.
1. About us and these terms
This website is run by Gift Diary. You can contact us at info@giftdiary.com.
These terms cover the website and the waitlist only. The Gift Diary app, including any Premium subscription, will have its own terms when it launches. The app stores you download it from (such as the Apple App Store and Google Play) will also apply their own terms.
Our privacy policy explains how we handle your personal information.
2. Using the website
You may use this website for your own personal, non-commercial use. You agree not to:
- use it in any way that breaks the law or is fraudulent;
- try to get unauthorized access to the site, its servers or any connected system, or interfere with how it works;
- introduce viruses or other harmful code, or overload the site with automated requests;
- sign up anyone else's email address without their permission; or
- copy, scrape or reuse the site's content except as allowed in section 5.
We may suspend access to the site, or remove someone from the waitlist, if we reasonably believe they've broken these terms.
3. The waitlist
- Joining the waitlist is free and doesn't commit you to anything. You must be at least 16 to join.
- Joining the waitlist doesn't guarantee early access, a particular price, or that Gift Diary will launch on a particular date, or at all.
- We'll use your email address as described in our privacy policy. You can unsubscribe at any time using the link in any email.
- We may change, pause or close the waitlist at any time.
4. Product information and prices
This website describes an app that's still in development. Features, screenshots, launch dates and prices (including Premium prices in pounds and dollars) show what we currently plan, and may change before launch. Nothing on this site is an offer to sell you anything. Prices and terms that apply will be confirmed in the app store before you pay.
5. Intellectual property
We, or our licensors, own the website and its content, including the Gift Diary name, logo, designs, text and illustrations. You may view the site and share links to it, but you may not copy, change, distribute or commercially use its content without our written permission.
6. Links to other websites
Any links to other websites are only there for your information. We don't control those sites and aren't responsible for their content, privacy practices or availability.
7. Availability and accuracy
We aim to keep the website available and accurate, but we provide it free of charge and “as is”. We don't promise that it will always be available, uninterrupted, error-free or free from viruses. We may change or remove any part of the site at any time.
8. Our responsibility to you
Nothing in these terms limits or excludes any liability that can't be limited or excluded by law. This includes liability for death or personal injury caused by our negligence, and for fraud. It also doesn't affect your legal rights as a consumer.
The website is free and for personal use, so, to the extent the law allows:
- we're not responsible for any loss that wasn't reasonably foreseeable, or for any business losses, such as lost profits, revenue or opportunities;
- we give no warranties or guarantees about the website beyond those the law requires, including any implied warranties of merchantability or fitness for a particular purpose; and
- our total liability to you for anything arising from your use of the website is limited to £100 (or US$100 if you live in the US).
Some places, including some US states, don't allow certain warranties or liabilities to be excluded or limited. If you live in one of them, some of the limits above may not apply to you.
9. Changes to these terms
We may update these terms from time to time, for example when the app launches. We'll change the “last updated” date at the top. If you keep using the website after a change, the updated terms apply. If a change significantly affects people on the waitlist, we'll email them about it.
10. General
- If a court finds part of these terms invalid, the rest stays in effect.
- If we don't enforce a right straight away, we can still enforce it later.
- These terms are between you and us. Nobody else has any right to enforce them.
- We may transfer our rights and obligations under these terms to another organization, for example if our business is sold. This won't affect your rights.
11. Governing law
These terms are governed by the law of England and Wales.
If you live in the UK: you can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring them in your local courts.
If you live in the US or elsewhere: these terms don't take away any protection given to you by the mandatory consumer laws of the place where you live, and you may bring proceedings where those laws allow.
